medcom.id, Riyadh: Saudi Arabia government executed a Pakistan citizen by the name of Amal Jan Haj with death penalty. Amal is a convict on the murder case of two Indonesian citizens.
The execution was conducted as he was proven and admitted the murder against Indonesian couple, Bambang Sugianto and Surati Widiastuti from Ponorogo in 2012.
The case started in November 2, 2012, as the two Indonesians were found dead in the burning locked room. Following the autopsy, signs of violence were found, as the investigation developed to the naming of the suspect, Amal Jan Haj. Under the approval and presence of their son, Hendra Aryadi Prakoso, both deceased Indonesians were buried in Saudi Arabia.
Following the trial process, which lasted for almost 2.5 years, in May 2015, Riyadh Court finally set death penalty against the convict.
"Since the beginning, Indonesian Embassy (KBRI) staff in Riyadh, along with its lawyer, Muhammad Al-Qarni, continued to attend the entire trial process and fought for justice for the victims' heir," explained the Consulate Coordinator of KBRI Riyadh, Dede Rifai who handled the case directly.
With the establishment of 'qishas' punishment, the convict's exemption from death penalty may only be conducted through the mechanism of pardon by heir, one of them by paying 'diyat'. However, until the license to execute was given by the King, there were no discussions about diyat.
"The suspect, who conduct his daily life as a taxi driver, had no economic ability in paying diyat. Meanwhile, his government did not provide any assistance in the releasing and diyat payment," mentioned the statement of the Director of Protection for Indonesians and Legal Aids of the Foreign Ministry, Lalu Muhammad Iqbal, in a written statement received by Metrotvnews.com, Wednesday (10/28/2015).
"As what we have always conveyed, no countries have paid diyat for its citizens proven to conduct murder in Saudi. Every diyat payment is the personal business of the convict towards the victim's heir," said Iqbal in addressing the execution.
Both Indonesians victims has a son. As an heir, their son has delivered an official letter of refusing to give pardon. The letter has been forwarded by the Foreign Ministry through KBRI Riyadh to the Riyadh Court. Having no pardon from the heir, the execution of the convict was conducted.
Throughout 2015, it is the second execution conducted by the Saudi Arabian government against the murderers of Indonesian nationals. On April 21, the Saudi government also executed Said Ali Al Qahtani for the murder of an Indonesian named Kikim Komalasari from Cianjur in 2010.
Different with Amal Jan Haj, who was sentenced by qishas by the court, Said Ali Al Qahtani was sentenced by 'ta'zir' death sentence, which can be pardoned only by the King. However, the King refused to give pardon, even the culprit is a Saudi Arabian.
