medcom.id, Jakarta: The Permanent Court of Arbitration (PCA) has announced its ruling on China's claim in the South China Sea. The PCA decided that China's nine dash line does not have any legal basis.
"The tribunal concluded that there was no legal basis for China to claim historic righs to resources within the sea areas falling within the nine dash line," PCA wrote in its press release, on Tuesday (7/11/2016).
The ruling is a big boost for the Philippines which filed the case in 2013. The country believes it has stronger claims in the South China Sea.
China's claims are based on historic rights, while the Philippines's are based on international law especially the United Nations Convention on the Law of the Sea (UNCLOS).
"To the extent China had historic rights to resources in the waters of the South China Sea, such right were extinguished to the extent they were incompatible with the exclusive economic zones provided by the Convention," PCA stated.
"There was no evidence that China had historically exercised exclusive control over the waters or their resources," it continued.
China has repeatedly objected the process in the PCA. The country prefers to hold bilateral negotiation with other claimant states in the South China Sea.
