JIS Escapes Rp1.6 Trillion Lawsuit

medcom.id, Jakarta: Jakarta Internasional School (JIS) had been released from the lawsuit filed by TH's (Theresia Pipit) parents, worth Rp1.6 trillion. South Jakarta District Court stated the lawsuit is Niet Ontvankelijk Verklaard or N.O., alias unacceptable.
 
Head judge Haswandi stated, based on the judges' consideration, TH's lawsuit was declared unacceptable. "Board of judges received the defendant's exception," Haswandi said in a trial session at the courtroom of South Jakarta District Court, Jalan Ampera Raya, Monday (8/10/2015).
 
According to the judges, the lawsuit was incomplete. The prosecutor should have also filed a lawsuit against the cleaning service personnel mentioned to conduct sexual harassment to their child. "The defendant lacks parties, as the cleaning service was not included in the lawsuit," the judge continued.
 
However, the cleaning service has been a convicted suspect on the criminal case of sexual harassment. Five cleaning service personnel, Zainal Abidin, Virgiawan Amin, Agun Iskandar, Syahrial and Afrsicha Setyani were sentenced in December 2014, for seven and eight years of prison.
 
In responding to the decision, JIS legal counsel Harry Ponto saw it as a victory. "As the judges panel basically agrees this case is unacceptable," he stated.
 
In his exception, Harry delivered that the cleaning service should be included in the defendant's party as they were considered to be involved in the case. "We declare lack of the parties of the civil case. As seen from the legal standing, they were involved," he stated.
 
He thinks it is a basic problem in a civil lawsuit. "It is basic. Not going into the matter of the case yet," he said.
 
Meanwhile, TH's legal counsel, Cinta Trisulo refused to comment on the decision. "We will still be coordinating with the team first," she said.
 
The lawsuit was submitted by TH as a form of responsibility and loss that JIS has to pay for the incident experienced by their child, who was said to have been sexually harassed in the international school.
